Devising a cost-effective solution
Sometimes it is helpful to separate dispute avoidance from dispute adjudication. This might be the case in a jurisdiction with statutory adjudication, where the parties involved are unable to contract out of the adjudication process, or where there might be concerns that the same panel carrying out dispute avoidance is also employed to decide disputes. A high-profile example of this was the 2012 London Olympics. Conflict Avoidance Panels [CAPS] are ideal where parties to a contract understand that dispute avoidance is a much more cost effective and time efficient option than formal dispute resolution.
Dispute avoidance at Sense Studio has its origins in the architectural projects we have carried out for over 20 years and underpins the philosophy of the practice.
