Expert advice for dispute avoidance
Used widely in construction disputes throughout Ireland, Conciliation is a voluntary settlement negotiation conducted with the support of a neutral Conciliator. The role of the Conciliator is to manage proceedings, review submissions and talk to the parties involved, both together and separately. They will make every effort to resolve the dispute, but if this proves impossible, will issue a recommendation. If the parties choose to adopt this advice, it will become final and binding, but if they decide to reject it then the dispute will go to arbitration.
